Outsurance refuses 3rd party claim

A lady hit my car and then proceeded to lie to Outsurance (her insurer). Outsurance refuses to accept the testimony of the witness in my car because we know each other. They don't care that her story has changed from her SAPS report. They won't request the video footage from Vumacam (I'm not allowed to because of the POPI Act), because it proves their client is guilty! They're not interested in the truth - they just want to avoid payment.

Hello Susan

Further to our initial response to your review, our legal liability claims manager provided you with proper feedback. It was confirmed that we have not disregarded any statements made by either party. A  third-party claim is not a standard insurance claim but one that is governed by legal principles. As such, the onus rests on you,
as the third-party claimant, to prove that liability has been established against OUTsurance our client.

It was also discussed that we have been in contact with your witness and explained why we require an independent witness. We also explained why we cannot obtain the footage on your behalf.

Thank you for affording us the opportunity to have discussed the matter with you.

Regards
The OUTsurance Team
