Re: 3rd party accidents

On the 14 December 2021, travelling on the N3 North taking the R24 East Exit at the Gillooly’s interchange.

The traffic is a stand still from Van Buuren to the Gillooly’s interchange. It usually takes an ordinary person around 15 minutes to await in the traffic.

My tracker report indicated it had taken me 15 minutes to proceed to 3KM.

I was stationary on the R24 Exit heading East, gradually awaiting the traffic to proceed.

Driver of a truck with 2 trailers Registration: KG 31 VF GP was impatient to bypass the traffic and gap in behind me, with the speed of the truck the driver was unable to stop in time and slammed into the rear panel and rear of my vehicle.

The driver of Masau Holdings PVT LTD was absconding from the accident scene, whereby I had to block the lane to prevent the driver from running away.

The case was reported to SAPS Bedfordview immediately after the incident, case number: AR 124/12/2021

The matter was reported to Outsurance, the relevant forms have been completed, quotation submitted, copy of the accident report was made available, pictures of the vehicle damages and my insurance no claim letter.

The damages are as follows: • Right back panel • Right taillight • Complete back bumper • The boot • I am not sure what else is damaged behind the visible parts

SAPS Incident Report indicates the following from the driver:

The driver indicated he was changing lanes from left to right, as he mentioned – in that scenario he would have knocked me on the left rear end and rear panel. Outsurance representative reports as per the below. The report was received from Thina Makhathini I quote: According to our client they were driving on the right lane of a 3-lane road, and you were driving in the far-left lane, both you and client entered the middle lane at the same time resulting in the collision. The driver was on the right lane changing lanes to the left, I was assumed changing lanes from the left to the right.

The above is a conflict between the driver and the client of Outsurance.

On the R24 Exit there are only 2 lanes.

Outsurance still over rules my report and is bias to their client to prevent paying out my claim.

Outsurance response:

The accident report is not conclusive and comprehensive hence we confirmed the accident with all parties to ensure that we have all the information that could not have been provided on the report

Due to there being conflicting versions we will not be paying from our client’s policy and this matter will be closed.

The above raises concerns of the integrity and credibility of Outsurance and Masau Holdings PVT LTD.

I would highly recommend reconsider your insurer and the Masau Holdings PVT LTD.

I have dealt with the following management with no logical approach. The CEO refuses to respond to my emails and lets his *********** employees respond with a general standard template:

Steyn Verster – Head of Legal – Claims Department – Who contacted me this morning 03 January 2022 informing me that his client excess is R20 000.00 and their estimated my claim at R15 000.00. I can proceed with legal action as he will be defending his client on all platforms. A very uncompassionate individual with no moral ethic or integrity.

It is unfortunate that all of  our attempts to resolve the matter on several calls from decision makers with the claimant have failed and we now have to air the matter on a public platform. We are the insurer for the business referred to. It is our responsibility to represent our client, based on our client’s version of events. As per our client’s version the driver was not at fault in this collision. As per the claimant, our client’s driver was at fault. When faced with such a dispute of facts without any other credible supporting evidence a claimant has the following recourse available to them: either claim directly against their own insurance policy; or pursue civil action against our client via the courts. Should the other insurer attempt to claim against our client’s policy we will defend this action based on our client’s version. Should the claimant pursue civil legal action against our client we will also defend the matter based on our client’s version. This may seem unfair to the other party claimant as both parties remain resolute on their respective versions. Should our client’s version fail in a court of law we will then abide by the court ruling. Until then, we cannot force our client to accept liability for the collision and will act in our client’s best interest. Any further explanation seems fruitless and we implore the claimant to pursue the available recourse that is available to every person in this situation.
