OUTsurance not honoring third party claim

My father was involved in an accident whereby an OUTsurance client bumped into him. The OUTsurance client he agreed that he was at fault and there were witnesses on the scene. Client contacted his insurance for 3rd party liability as he is the policy holder. As I am the contact person for this claim, OUTsurance requested documents which were all submitted. They said it would take 6 weeks to process but only responded after 2 months when i called them. On this call with the OUTsurance representative, I was told that due to the damage (based on photos) that both cars will be written off and based on their calculation the apportionment came to a minus, and they would not be honoring the 3rd party claim. I then disputed the outcome of this claim with reasons why I believe that their apportionment is wrong and that their client is 100% to blame. OUTsurance disputed this and also stated that no admission of full liability was made.
To make matters worse, the apportionment was based on their client's car being written off, however, the client's vehicle was seen on the road again and he confirmed that his insurance (OUTsurance) took care of the repairs.
This matter will be taken further.
Further to our initial reply to you, we received feedback from our liability claims manager, confirming proper feedback was provided via email.
We would like to clarify that we have not denied liability. Instead, we accepted a shared liability outcome, where our insured is considered 60%
responsible, and your father 40% responsible. The principle of apportionment was explained in more detail. The 3rd party claim ended in a negative settlement value, meaning the damages claimed for, exceeded the portion of liability we could legally accept.
We understand your father is out of pocket which is unfortunate. Thank you for allowing us the opportunity to have reviewed the matter and provide you with comprehensive feedback.
