Outsurance Ignoring Statutory Road Rules and Official Evidence in My Claim

I wish to formally record my dissatisfaction with Outsurance’s handling of my third-party claim. The decision reached by Outsurance is legally and factually unsound, and reflects a clear disregard for objective evidence and established road-traffic laws.

The official accident report — completed by SAPS — confirms that the Outsurance-insured driver failed to stop at a stop sign, thereby violating National Road Traffic Regulations, which requires a full stop at a stop sign before entering an intersection.

Despite this, Outsurance has rejected liability on the basis that their client “believed she was approaching a four-way stop.” This justification is both factually incorrect and legally irrelevant:

1. The intersection is not a four-way stop, and this is objectively verifiable. 2. Even if it were a four-way stop (which it is not), the insured would still be legally obliged to come to a complete stop — which she did not. 3. A driver’s “belief” or misunderstanding of road signage does not absolve them of negligence, nor does it override statutory road rules or the physical road markings shown in the accident report.

Outsurance’s position effectively ignores the official police report, photographic evidence, video footage, and the insured’s admitted failure to stop.

It is deeply concerning that an insurer can dismiss statutory obligations and documented facts in favour of an unsupported version from their client.

Their client’s negligence has caused me financial loss as my vehicle is used for business purposes, stress, and significant inconvenience, despite me being the innocent party.

I am in the process of formally disputing this decision through Outsurance’s internal resolution team, and will escalate the matter should this procedural unfairness persist.

Consumers deserve objectivity and fairness — not decisions based on assumptions that contradict the law and evidence.

Your response is noted, but it fails to address a single legal or factual issue I raised.
Escalating my matter to a “legal manager” means nothing unless you intend to correct an outcome that is plainly contradicted by statutory law and official evidence.

It is unacceptable for an insurer to disregard statutory obligations and formal police findings in favour of a version that conflicts with both the law and the evidence.

This is not simply “disappointing” — it is procedurally flawed, irrational, and inconsistent with the standards expected from a licensed financial services provider.

I expect your legal manager to provide a substantive, legally grounded justification for your decision — or to rectify it.

A vague apology is not an answer to a misapplication of the law.

Please be advised that I will escalate this matter through every available internal and external channel, including the Ombudsman, should this legally incorrect outcome remain unchanged.
