Outsurance failing to pay for damages

I was involved in an accident on the 12th of June and the person that hit my car was driving a company car, he hit me on the side. And i had to submit all evidence inluding pictures and all that. So a guy by the name of Aphelele called me today and said that their insurance wont be paying because i had to be careful on the road when their customer was the one who was reckless and said that he didnt see my car coming and that is because he didnt check his sides he just got on the road without looking and he admitted on the accident report.
