OUTsurance 3rd party ********* and dishonest dealings when having to pay out.

I got into an accident on the 11th of Aril 2025 and the car that rammed into me is insured with OUTsurance and at the accident scene, the owner of the car was very helpful, he called OUTsurance and they agreed with the towing company to tow my car to their yard as OUTsurance will evaluate the car from there as per the procedure they were told over the phone. I proceeded to cancel my towing company and the car was taken by the OUTsurance authorized towing company.

As I proceed with the 3rd party claim over the weeks, I was informed by the OUTsurance consultant Lindi ( who was helpful) that they will not be paying for any towing or storage fees. Do note that if I had not persuade them about fixing my car and getting me a courtesy car as I rely on my car to work , I would not have known that the car was not inspected nor that they would not be paying for the towing and storage fees. when I contacted the person that bumped me they told me that Outsurance told them that they should tell me that they are not liable for any towing and storage costs thus from there on they denied ever agreeing for my car to be towed or having mentioned that since their are liable, Outsurnace will cover me via their 3rd party. They now say that I spoke to Lindi over the phone at the accident scene and she told me that they are not liable for any towing costs nor are they admitting to liability. They were obviously coached which its very ********* and appalling because the driver was taken by an ambulance, how could she confirm that she said to me that she is not liable? How did I know that they are covered by OUTsurance? Why would I allow my car to be taken with their car whereas I live close to the accident scene ? I had to pay R 13 380 to get my car to be taken from their towing company's yard to my house, mind you that my house is less then 10 km from the accident scene.

After a few back and forth with OUTsurance 3rd party legal department they agreed to pay only R2000 towards the R13 380 I paid their towing company, this is very unfair, I did not willingly give consent for my car to be towed they insisted that they should tow it so as to validate the claim and to get it assessed for repairs. Secondly, I did not bump into my self, their client which they promised to cover them bumped into me. Thirdly, now they are changing from not paying to paying only a portion, this just shows that its not that they cant pay , they just want to frustrate me until I gave up the claim.

To date I did not get a courtesy car and my leave days have depleted leaving me to have to pay more money to hire a car in order for me to work. Whenever I call for an update they tell me, their manager still has to approve , imagine it's almost a month without being able to work and no approvals have been done.

I am now pursuing this matter legally and fortunately the police officers that were there, my brother and the guy that towed my car are giving my lawyers affidavits confirming what happened. I feel bad for the couple that bumped me because now they will have to pay for my towing, storage, car hire and legal fees while they are insured, what a waste of money on their side. If you have OUTsurance 3rd party cover, just know you will still be sued as they wont cover up to R5m as they claim, look for a more honest and ethical insurance company. Lastly, them coaching you after the fact does not save you at all instead it helps prove a case against you and in today's world we record everything.

It would be nice if all your departments respond so fast and politely. I would be very happy if you can reimburse the towing and storage fees I paid so we can put all this behind us continue with life.

Further to our private reply, we received feedback from our liability claims manager, confirming he was in contact with you and your concerns were discussed. It was also discussed that no advisor made a commitment for us to pay for car hire, towing or storage fees.
These are typically excluded on 3rd party claims. We will only offer to pay car hire in these instances if the 3rd party claimant van confirm they use their vehicles for business use.

We discussed the contribution we are making towards the towing charges.
Our settlement offer was discussed with you and we are pleased to know you are satisfied and thank you for your understanding.
