my girlfriend and I cars are parked in the street overnight, so at about 4 am we heard a loud bang we jumped out of bed ran to the front door because it sounded like 1 of our cars was involved. Then saw what look like an uber or Taxify car hit the back of my girlfriends car and pushed that car into the back of my car, we then got the owners details from the car which knocked our cars. We then went to open an accident report, Now Outsurance came back and stated they are not going to pay us out because the driver wasn't negligent, he was negligent driving around at 4 am with his employer's car even though he was blocked from Taxify and uber, that sounds negligent to me. Its not our fault that he was trying to make some money and then they tried to rob him and he crashed into our cars. We have pictures of the accident, and the owners contact details

Then they send me the following email "The above matter refers. According to the information at our disposal, our driver was faced with a sudden emergency. Based on this there is no other option but to refute liability as our client was not the cause of the accident and no negligence portrayed by our client the accident was due to the ******* in the vehicle while he was driving. We are proceeding to close our file.

We fully understand your disappointment.

Our liability claims manager explained our client's passenger in the shuttle ****** him while driving and pulled up the handbrake. The accident could not have been avoided.
In order for a 3rd party to succeed with a claim, the client had to be negligent. This was not the case.

Our advice was for you to claim from your insurer.

Thank you for the opportunity to clarify why liability was refuted.
