Not living the 'HONESTY and INTEGRITY' value

<p>Claim ********** 41; I worked for Outsurance between 2012 and 2015. Some of the values we were taught were 'Integrity and Honesty', infact we were taught to be honest even when no one was watching us.</p> <p> </p> <p>Fast forward to 2017 March 8, their client knocked my car on the side while I was driving on N2, causing me to loose control of the car which resulted in costly damages to my vehicle. At first the guy changed his stories and made couple of false claim until he admited that he did knock my car on the side</p> <p>Now legally I can't claim from Outsurance because they are not my insurance, but their client is liable for the damges caused to my car and as such his R5 million liability cover they are always preaching must cover the damages I sufferd. For that I called them and leaned that their client had already informed them of the incident, they advised me to submit my third party claim with their claim number, their assessor from Durban called me to get the side of my story, after a series of telephonic and email follow ups, they came back to tell me that they are rejecting my third party claim because their client bumbed my vehicle whilst trying to avoid hitting a vehicle that cut in front of him. I mean, wether the alegation of another vehicle is true on not, that has nothing to do with me and Outsurance knows that</p> <p> </p> <p>Now here is the hypocricy; there are many option that a driver has whenever there is a danger infront of him other than driving into another vehicles on another lane. Infact this is something that code B drivers liscence holders are tested on during their drivers liscence test, which makes their client liable to the damages my vehicle suffered. Something I know for sure that Outsurance clearly knows as a company that deals with this similar cases on a daily basis. I mean. I find it sad that I will now have to sue the poor guy and end up taking him to court over something that Outsurance as his insurance could have easily resolved without involving any lawyer.</p> <p>2. I know that insurance companies, especialy Outsurance tells their client to never admit guilt in any accident involving another party, but in the name of honesty, if you bumbed my vehicle, especially where you drove in to my lane, you should take responsibility and pay.</p> <p> </p> <p>I am busy finalising my civil claim lawsuit against their client, he knows and he even attepted to approach one of my legal represantative I still dont know for what reasons. It sad that at some stage he will have go to court regardless of his schedulle for something that could have been easily resolved by his insurer which is dishonest when dealing with third party claim</p> <p> </p> <p> </p> <p> </p>

Hi JBM23,

Thank you for bringing the matter to our attention. Nompu our legal manager contacted you to discuss the merits of the claim. She went into detail with you surrounding the Law of Delict and collision. You mentioned to her that you will contact your attorney.
