No feedback on excess due to me

On 1 April 2015 my husband and I were involved in an accident through no fault of ours. When lodging the claim, I informed the consultant that there were two Outsurance pointsman on duty at the intersection, but they were standing on the pavement busy with their cellphones. I believe if they were regulating traffic as is their job, the accident could have been prevented. My car was repaired, however, I had to pay the excee of R3800 as the third party that caused the accident was not insured. On 2 September 2015 I received an sms stating that the recovery file (Ref no ********** 36) was re-allocated to Charmaine de Waal at the Legal department. I have to constantly contact her for feedback and lately she is not responding to emails. The last feedback I received was months ago, the third party is unemployed but is married in community of property, thus his wife will be liable to pay the excess. Since then I have not had any further feedback. The accident happened almost two years ago, surely there should have been some progress by now? Please advise as I need to know what further steps to take.

Regards,

Michelle

ID no ********** 004086

We are sorry to see you did not receive an update when you requested same.

Our legal recovery manager, Elizna has been trying to reach you and finally corresponded with yuo via e-mail now.

She confirms summons was served on the other party, but our attorneys have not received their plea. We are proceeding with judgement against the other party. It also needs to be said the litigation process is a lengthy process and we are not in a position to give time frames.

Please feel free to contact Elizna directly should you have any further enquiries going forward.

Regards

Dinky
