Nightmare at the hands of OUTstrance
We bought a vehicle from an auction in Cape Town in July 2024 and contracted a towing company to deliver it to Pretoria unfortunately the truck got involved in an accident and our vehicle got completely damaged. Our business and working capital has been tied down now for six (6) months and counting.
The Towing company involved in this accident is - Wheel of Afrika Towing and a client of OUTstrance. This is how and where our nightmare.
It was a nightmare to obtain any information about this accident from the Towing company. In fact they kept the accident a secret for over a week.
We had to involve the police to just obtain some simple basic information about this accident (ie what happened, when and where did the accident happened, where is our motor vehicle and case number and police station where it was reported) from the Towing company.
Needless to state the Freedom of Information Act, Road Accident Act and the SA Constitution affords us the right as the vehicle owner the right to be informed of what has happened to our property.
This Toyota Avanza is a private property and the right of ownership is ours. This vehicle Is not the property of the Towing company. A simple fact that OUTSURANCE ought to have acknowledged and respected in the first instance.
We had to pay and employ the services of a lawyer just to compel or force OUTSURANCE to release our vehicle in September 2024 from Bloemfontein. Bear in mind this accident happened around 4th August 2024 and OUTSURANCE aggressive advertising is that their are within hours.
OUTSURANCE has since finalized the cliam - *** and only paid out the purchase amount on the invoice to their client Wheels of Afrika Towing needless to mention that the cost of the damages is over R80,000.00 for parts alone excluding labour.
We were not informed by either the Towing company or Outsurance that this claim *** has been finalized. How and where Outsurance got our purchase receipt/invoice used to finalize this claim is still a mystery. How and where OUTSURANCE obtain our purchase receipt from the auction company without our consent is equally a another mystery and we are still waiting for their explanation.
We humbly refer OUTSURANCE to the clear provisions of sections 40, 41 and 42 of the Consumer Protection Act 68 of 2008.
It is false and deliberate misrepresentation if OUTSURANCE paid out an amount of R50,370 to Wheel of Afrika Towing their client, and their client inform us R20,000.00 the pay out amount.
It is unconscionable conduct and amounts to ***** for such an official information and fact to be misrepresented.
We believe that OUTsurance have an ethical and moral duty and standards to disclaim such false and deliberate misrepresentation and report this incident immediately to to the police without alleging Poppy Act this and that and frustrating even futher the rightful owner of the vehicle.
Freedom of Information Act and Consumer Protection Act are very clear with regards to right to information as well as the Constitution.
This vehicle in cliam is undeniably our vehicle and property. We are the rightful owner unless Outsurance or the Towing company thinks otherwise. The money paid out on this claim is our money not Towing company,
OUTSURANCE must live up to their moral and ethical obligations and provide basic information to us in order to prosecute a *****ster.
