Motor vehicle accident claim rejected

On the 26st January 2015 Mr EH Van Vollenste collided with my vehicle. The accident was due to negligence of Mr. E. H. Van Vollenst, as he collided into me and therefore he is responsible for damages. Seeing that I am not insured his insurance, in this case Outsurance would have had to fix my vehicle or pay my damages but have since rejected the claim as the Mr van Vollenste apparently skid on gravel. Still this is not my fault and someone needs to pay for my damages. I do have Photo's of the accident and the scene of the accident and there is no gravel on the road. (This by the way is a tar road).<br>
