Losses incurred due to premature findings on accident report by Outsurance

In the event of an insurance company prematurely declining a vehicle claim, and years later the State could not gather enough evidence as previously concluded by the insurance company for declining such a claim. What clause allows the consumer the right to reinstate the claim, if possible, for the losses incurred for this ordeal.
