Good at taking your money, but a lot of issues when it comes to pay-outs!!!!!

I live in George and work in Mossel Bay. The morning of the 24th November 2020, I was driving to work as I normally do. I was driving in the direction of Mossel Bay on Louis Fourie Road as you would be coming into Mossel Bay from the N2 Cape Town’s side. Asla Park was to my left. It was about 7:35 in the morning.

I kept within the speed limit, which is 80km/h on this section of the road. I was driving between 65km/h and 70km/h and kept in the left lane of a 4 lane road with two lanes in each direction. I know people and kids regularly run across this road and that you have to be extra careful during busy traffic in making observations. During this time of the day there are also a lot of people standing on the corner waiting to be picked up for work. This part of Louis Fourie Road has 4 lanes, 2 lanes going into Mossel Bay and 2 going out. It was at about 7:35 when the crash happened and the usual morning traffic. The road was not wet and there were no fog or anything that could hinder ones vision.

Mrs. B was driving from Mossel Bay in the direction of Cape Town. Mrs Bekker did not stop where one would expect when taking the turn-off to Asla Park into Crotz Road and instead accelerated in what I would say an attempt to avoid waiting an extra minute or two during this busy traffic time of the day. Since she did not stop, it was like a car driving normally in the opposite direction suddenly decides to turn right in front of you. I was almost at the turn-off when Mrs. Bekker took this sudden turn. When Mrs. Bekker took the turn ending up right in front of me, I stepped on the brakes as hard as I could and tried to steer the car away from oncoming traffic that would cause even more possible harm. In a picture taken one could see my brake marks and how close I was to the turnoff when she thought it to be a good idea taking the turn anyway. My car came to a stop about 15 meters in front of a taxi waiting for me to pass as well before he could drive.

With the left front side of my car, I hit her car on the left back bumper and the force pushed her into the taxi that was standing at the Stop Street coming into Louis Fourie road from Crotz Road. With her right back bumper she hit the front right side of the taxi and left the road on the left corner of Crotz Road, towards a jungle gym for kids and came to a stop in front of a kids slide. She was driving so fast that she only came to a stop about 50meters further. I came to a stop in front of the taxi. If I was driving faster I might have stopped further and could have crashed into the pedestrians standing to the left of the taxi. Taking a turn on a 4 lane road one should be extra careful since it would be a longer turn and one should allow for a greater distance between oneself and oncoming cars. Mrs. B living in Asla Park and regularly driving this road should have known better from experience that this is a difficult crossing and should have been more patient before taking the turn. She did not drive slower taking the turnoff, stop before turning or make appropriate observations. If she did she would have seen me. She is a danger on the road and could have caused me my job if injured. She drove off the road and came to a stop several meters from a public jungle gym where kids was busy playing. My car was a write of and though hers was only damaged at the bumper her insurance company Outsurance claim her car is written off?

So she was ensured by Outsurance and I with a different company. I tried the route of lodging a 3rd party claim. So at the end the feedback from outsurance was that I was 25% responsible for the claim. That used a case from 1986 as backup and them said that I am now responsible for the damages to her car. So they made me a offer of about R3400as payout for my car that has a market value of about R 40 000. So now I will have to claim from my insurance coming and after all co-payment deductions I will be left with less than R 20 000.

This accident was clearly the fault of the client of Outsurance and their feedback absurd. And later I found out that is working for the police as well at the police station that came out to the seen. Needless to say more on how this case was handled.

Seems like they are good at making false promises of TV , take your money easy and then payout poorly! But I guess if you spend so much money on adverts having to make people think you are a good company, they will have to make it back in some other way.
