Failure to claim from a third party at fault ,if both claimants are insured are with Outsurance

Our vehicle is comprehensively insured with Outsurance. We were involved in accident with an Uber driver who accepts fault. The legal department at Outsurance admits the Uber driver was totally at fault. The Uber owner is also insured with Outsurance. Outsurance claims the Uber owner refuses to admit fault so they are unable to lodge the claim against his policy , which they are entitled to by the law of subrogation. By taking this action Outsurance is forcing us to pay an excess we should not be responsible for and suffer the loss of a large Outbonus due to us. Outsurance is a BULLY who is happy to accept our premiums but will manipulate the claim so that the insured suffer the greatest loss possible, obsolving themselses of their responsibilty . BE WARNED ...... Outsurance is NOT on your side!
