Denial of a Liability car insurance claim
On the 21st January 2018 I driving back to Joburg from Pretoria when I was involved in a car accident. I was driving on Botha Ave approaching Nuwe Road right side junction when a red Volvo did not stop on the stop sign and hit me on my right fender while I had a right of way.
The driver of the red Volvo immediately admitted that he was at fault and we then exchanged details. We then both proceeded to SAPS Lyttelton to open a case. ( case number AR 206/ 01/ 2018)
He also signed an affidavit which confirms that he was responsible for the accident therefore will claim liability with his insurance company which is Outsurance.
Today which is the 2nd of February 2018 I received a letter on email from Outsurance denying my liability claim which was submitted by their client who hit me.
Outsurance claims that I was negligent mean while I had the right of way and he didn't obey the stop sign .
Outsurance also says that we were both negligent therefore we're both liable for repairing our own cars and they will not honor my liability claim.
I'm appall by their refusal of my liability claim as I was never at fault and was obeying the rules and regulations of the road. The fact that even their client admitted to the wrong doing which resulted in an accident further annoys me My car is not insured therefore they also claim that they won't repair the damages because since their client is insured and I wasn't, then there's no contract that binds them for liability. .....which is absurd according to me.
What if I was at faultand the same situation of the accident happens,? Applying their rationale,does this mean that I would also be not liable to pay damages for his car ?
What I would like to see happening is for them to repair my car
