Case closed and excess not refunded
<p>We have been informed that the case of our claim has been closed since the 3rd party do not want to settle after we have been assured by the lagal dept. that we are not at fault, the 3rd party is totally liable. Now we have been inormed that we are now liable and wrong and therefore lose our excess.</p>
We are sorry about the disappointment. We will at all endeavour a successful recovery against the other party should the merits allow for it.
Our legal recovery manager, James did discuss te rejection of recovery reasons with you. It was confirmed you were more liable for the accident, which resulted in the other party's insurer to refute our liability claim against their client.

I don't think the reasons explained made sense.
The reasons was given as follows "you turned right therefore youare liable".
If I turned left I would have been in the veld.
We have an eye witness that saw the whole incident and gave a report.
We were told by Outsurance legal dept. via the phone that we were not wrong.
No emails as I asked for. Looks like they are scared to put pen to paper.
James did explain that they will persue this even going to court.
So If we can be explained again why the original liability has changed.
