3rd party Claim rejected

Good day My claim against OUTsurance client was rejected by the Outsurance because there say there client cannot be held legally liable for the incident it is our informed view that the damages to your vehicle occurred as a result of both drivers not keeping a proper lookout and made sure that it was clear for them to reverse out the parking bay, by south African law you can reverse for as long as possible only if it is clear for you to do so. Both parties contributed equally to this incident therefore both parties should bare their own costs. Yet their client admitted that it was her fault. In light of the above we confirm that we will not pay out your claim and will proceed to close our file. So now i am left with the cost to repair my vehicle. Is this fair.
