3rd party claim a joke

<p>Had an accident where the person pulled out of he's driveway right infront of me ( my right of way to drive), and I had to slam the brakes and hit him at the back. After the other vehicle's driver acknowledge he was at fault and after stating this in an affidavit, Outsurance claims that the driver's vehicle was stationary ( can't see any reason why as he was reversing out of he's driveway infront of oncoming cars who's got right of way) and then they claim I lost control of my vehicle and then slam into him. How can they make a statement like that when a person turned infront of you and you try to avoid an accident. The driver surely didn't see me coming down the street or just didn't look properly for oncoming cars. How can Outsurance then reject my claim and tell me I lost control of my vehicle. Surely you can see they make up a story just not to pay for their clients mistakes.</p>

Reviewer Update

After trying to talk to Outsurance and giving them proof that their client was the guilty party in this incident, they still deny my side. Throwing a story that their client was stationary when I colided into him from the back. Surely if any body reverse out of he's property and over a solid line, into my line which I have right of way, I still don't know where a vehicle is stationary when reversing. If a car was stationary surely he must then have a triangle placed behind he's vehicle with he's indicator lights on as a warning for oncoming vehicles.Surely you can see that their client reversed out of he's property, over a solid line, into my lane which I have right of way, he didn't obay traffic rules by means of not looking for oncoming vehicles and crossing a solid line. And still after I showed them proove. I will contact the Media/Ombudsman if they don't resolve this story of them.

We note your feedback and our Liability claims manager confirmed there is a liability dispute between the two involved parties.

Our client was stationary, slightly in the road when you approached and collided into his stationary vehicle. The accident happened in clear daylight and was completely visible. Our client is not legally liable for the damages as his vehicle were stationary.

Your client was not stationary and was not SLIGHTLY in the road. He reversed out of he's property from the other side of the road, over a SOLID LINE, into my lane. When I collided into he's vehicle he was in the middle of my lane. How and where do you get SLIGHTLY in the road in such in incident?
