Ref:- 505573 R1.000,000 Tourneo Sold as New; Leaks & Prior Repair — 133-Day MIOSA Case: Serious Defects, No Ruling — Sent to Bidvest Instead
Headline: 133 days later, Miosa SA Motor industry Ombud says “contact Bidvest” - still no ruling
I bought a new Ford Tourneo (~R1,000,000) from Ford Vereeniging. Soon after delivery the roof and back door leaked heavily. An independent inspection showed evidence of prior repair/accident, yet it was sold as new with no disclosure.
I opened a MIOSA case on 9 April 2025. As at 20 August 2025 (133 days / 19 weeks later), MIOSA now tells me to “contact Bidvest” because the dealer closed - no decision, no remedy, no timetable.
Under the Consumer Protection Act (s55–56 quality, s41 non-disclosure, s61 supplier-chain responsibility) I expect a written determination and a practical remedy (replacement/refund or full repair at supplier cost and refund due not being a new vehicle).
Desired outcome: A formal ruling identifying the responsible party and the remedy within 10 business days. Evidence available on request.
