Motor Industry Ombudsman SA - Lack of Service
Case Number: 356276 I reported a dealership to MIOSA on 12 March 2019. I bought a vehicle with multiple faults, one being a leaking radiator which resulted in a blown head gasket and cost R25k to fix. The warranty only covered R8k of the bill and I had to pay in R17k out of my own pocket. This all happened within a month of me purchasing the vehicle. I sent my claim to the ombudsman on 12 March 2019 and on 18 March 2019, they sent an email to the dealership and included me in the email. Their email to the dealership clearly stated, and I quote, :We look forward to receiving your response within 10 business days from the date of this communication". They also stated that should the dealership ignore or not respond to the claim, they may be liable for a 10% administrative fine of the suppliers annual turnover or a fine of R1m. With their requirements outlined above, I sent a follow-up email 12 business days later, on 3 April 2019 and had no response. I then sent another follow-up email on 16 April with no response. Another email on 23 April, informing them that my vehicle went into limp mode whilst on a long trip, with no response. Another email on 20 May and had response that they are working on my case. I sent another email on 19 June 2019 stating that my vehicle went into limp mode whilst on a long trip. Another email on 18 July 2019 informing them that my vehicle went into limp mode whilst on my way to work. I sent another email on 22 July 2019 and was informed that they were busy with my case. I sent another email on 19 August to follow up and had no response. Another email on 27 August with no response. Another email on 4 September informing them that not only does my vehicle go into limp mode, but not the handbrake light and oil light burn constantly. I sent another email on 9 September reminding them of all the faults and that my drivers seat has also fallen back and wont return back up to support my back whilst driving. The seat is still like that today. I sent another email to follow up on 20 September, 6 months after my initial claim and had no response. I emailed again on 7 October 2019 with no response. Apart from all my emails to them, I did also call to follow up and was rudely greeted by someone who didn't sound like they wanted to be there and was informed that my case was on-going and had been put back in the que???? I had previously spoken to someone who agreed to try escalate my claim. The last man I spoke to also said he would escalate my claim, but I don't feel confident this will happen. I just don't know what to do anymore. With feeling I have a strong case against the dealership, I have avoided spending more money on the vehicle to rectify all the faults, in anticipation that my case will be heard and I am successful with my claim.
