MIOSA - NONCHALANT ORGANISATION

I purchased a vehicle on the 19th August 2021 from Autohause Beyers. On the 22nd August 2021 ( 2 days later) mechanical defects started surfacing. Autohause Beyers took the vehicle in to their mechanic for repair - vehicle eventually collected by the end September 2021 - after a day the vehicle refused to start. Problems diagnosed as bearings worn , crankshaft shot. Cost of repair R150 000-00. I attempted to resolve the matter with the dealership. The Dealer Principal refused to settle the matter amicably. He informed me that the previous owner was his best friend and he could therefore vouch for the vehicle being maintained- which was obviously a lie. I submitted my complaint on the 9th December 2021. By the 3rd February 2022 MIOSA was in possession my complaint, the dealers response and my reply - all that will be required is for MIOSA to make a decision. From February 2022 to date I have made at least 30 enquiries about the status of the matter and have been rudely informed that being a NPO MIOSA does is understaffed, that they are not confined to time frames for response or activation of claims, that since the 3rd February 2022 my matter is pending allocation for a decision. I am and have being paying Marquis Finance the sum of almost R7000-00 in respect of finance, R1300 for insurance for a vehicle which I used for merely 2 days and on approaching the institution, which supposedly has been created to assist I am being ( by my interpretation) told to '**** off''. I have gone to the extent of calling the Presidential Hot-line to obtain numbers for the Board of Directors of MIOSA- unfortunately they could not assist as this is outside their scope. Marquis Finance refuses to be of any assistance as they are of the opinion that since I reported the matter to MIOSA I am responsible to follow up on the matter. What Marquis Finance refuses to acknowledge is that their Legal Officer instructed me to report the matter to MIOSA and further that they are owners of the vehicle which is in my 'possession'. It is evident that MIOSA has no concern for the complainant. One cannot be blamed for making the assumption that MIOSA acts in favor of the dealership as the time taken to make a decision also impacts the consumers other legal rights which are subject to time prescriptions. I am now going to litigate, but loathingly as I have lost 6 months of a process which is guaranteed to provide feed back.
