Awaiting outcome going onto 2 months with no update for a straight forward case.

I am waiting since 02-08-2022 for any sort of feedback or status update. Case Number: 381979

I am always told to exercise patience with no status update.

Here is my complain against BMW Sandton and Auto Alpina Randburg:

Statement in support of Request for Intervention - MUSHIN KADER

I approached Auto Alpina with the request to purchase (either from stock or to source on my behalf) a F20 118i BMW M-Sport with approximately 100 000km mileage for me to purchase.

I expressly requested that the dealership verify and confirm that there was no accident damage and that the vehicle was mechanically sound.

A vehicle, which was represented as meeting the aforementioned requirements and being fit for the purpose it was being acquired for was presented to me, which vehicle I then purchased with finance obtained from Wesbank.

On 27 April 2022 when I took delivery of the vehicle their representative handed me a printout and advised me that “the car was involved in a previous accident and he did not want to lie to me”. When asked why this was not disclosed to me prior to purchasing the vehicle I was offered an apology. With the financing and registration being finalised I saw no option but to accept delivery of the vehicle.

Since taking delivery of the vehicle I have not had any significant use of the vehicle. Below is a summary of what has transpired to date: o 2 Days later on Friday the 29th April 2022 an error with the drivetrain appeared. The vehicle was immediately returned to the dealership for diagnostic and repair. The vehicle was only returned 15 days later on Friday 13th May 2022 with the assurance that everything mechanically was within BMW spec and that the car is perfectly fine. o The very next day, Saturday 14 May 2022 the drivetrain error appeared again and the vehicle was returned to the dealership on Monday 16 May 2022 for diagnostic and repair. This time the vehicle was only returned a month and a half later on Thursday 30th June 2022 with the same assurance that the vehicle has now been repaired. o However, on Saturday the 2nd of July 2022 the turbo failed and the vehicle was again returned to the dealership for repair and has to date not been repaired and/or returned.

On or about the 14th of July 2022 I forwarded a demand for the cancelation of the agreement to them to which I received a response from their attorneys on the 19th of July 2022 advising they will be consulting with their attorneys and advise (copies of which is attached hereto).

As at date hereof, being the 27th of July 2022, I have not received any further communication from either dealership or their attorney and the vehicle remain with the dealership (from the 2nd of July 2022). In the interim I have been without transport and remain obligated to maintain payments in respect of my instalment sale agreement with Wesbank and the vehicle insurance without any indication or communication.
