Ombudsman is bias in favour of Momentum
I had brought a case before the ombudsman, I have proof of requests for a contract in English from Momentum which Momentum did not send me the contract in English (Long Term Insurance Act 52 of 1998 - 48(3) - The policyholder shall be entitled to be provided, upon request, with a copy of the policy.). The application stated English, there was a phone call that showed language change even after Momentums original mistake of sending it in Afrikaans, which Momentum still has not sent me after 6 months.
Mrs Mills findings in the matter ended up being wrong because: 1) Mrs Mills contradicted herself in 2 points of the findings; 2) Mrs Mills imp**** that the contract in the wrong language is perfectly acceptable (even though it is not as this means the contract is not transparent among other things); 3) Mrs Mills had sent me an email between herself and the Momentum investigator where they were communicating on a first name basis, this shows that this was not being handled in a professional way but rather that the two of them are friends / acquainted.
Momentum literally broke the law by not sending me my contract when I had requested it. Mrs Mills said that I had experienced poor service and the a compensation of R 1 000.00 for poor service was offered. This was not a case of poor service but more a case of Momentum broke the law and I was trying to have this sorted amicably instead of having to take legal action, which is what I am obviously now going to be doing.
