Worst assitance after making a mistake

I had a retirement anuity fund with Old Mutual that I had transferred to another (section 14) and now they handed in a tax directive with the incorrect codes indicating that I got a pay out but the funds was internally transferred. I had a financial advisor who seems to not care because I left Old Mutual. SARS stated that Old Mutual have to correct the code on the tax submission but nobody seems to care...

We apologise for the inconvenience this has caused you.

We do not enter codes on the directive, we apply for a specific directive at SARS and the codes are automatically generated as a result.

We will however investigate and resolve with you directly.

The source code of 3920 is correct as it is in accordance with the SARS PAYE BRS (Business Requirements Specification) for the 2017 tax year. The fact that the description on the certificate states ‘RAF lumpsum withdrawal on or after 1 March 2009’ is moot as the tax is nil, and the tax certificate indicates a non-taxable reason code further down on the tax certificate that states that the earnings are non-taxable. The description on the certificate is as per the SARS BRS which in accordance with which iTax (our tax submission system linked to SARS) would have developed. That cannot be changed.

An IT3A tax certificate is required to be issued for all non-taxable or untaxed earnings. It has therefore been correctly issued.

On 22/02/2018 we provided your tax certificate to you and e-mailed an IRP3e confirming that you are not liable as the funds were in the form of a transfer without a cash option.

SARS need to see both certificates as the tax certificate (it3a) and the IRP3e issued by them, together confirm the Section 14 transfer fully.

We trust that this provides clarity in this regard.
