Unbinding funds because of reference that requires an attorney after magistrate’ granted the funds

I contacted old mutual last week concerning the process I have to start via them over the court ruling of decree of divorce which granted me 50% of the spouse provided fund with old mutual. As a single parent unemployed I am doing things on my own without a lawyer since I can not afford one.

At first with calls the take time, secondly I reach a lady who ask me to email the court decree of which I did so. When I call again confirming if the email successfully reached and to require about the process on wards. The next male service attended did not give a good service and while on which I find his question awkward that includes “what assets did your spouse left you with, do you know how much money is, what is your plan with the money” after all this questioning he would go quiet when I call out he told me that he was consulting with his colleague of which after the second silence he was tell mentioning the assets because i need an attorney because I was not going to be allowed to access the funds that they need paper work from the attorney that confirm what I am allowed get what the agreement was. Of which I as him of the court that I have he went on silent of which the next reply was he will transfer me to the other person who will provide for me where to email the court documents of which I had already done that.

It was quite stressful to me of which the same day I reach out to my friend who helped me with calling of which the quite give attention to and told us to wait till Friday for their after re sending the decree and I’d they as requested.

When we got the reply from Maxwell Oktober (servicing consultant) Which he rep**** the divorce order is not binding because of fund not cited correctly that also defendant can not pay the pension interest as claimed on divorce order that the order should be amended to reflect the correct wording, intention of the parties and citation of the correct fund name. Of which my question is if I had provided the member that I only know of and recorded while processing the divorce I did not know their requirements neither did the service provider at court knew such she only asked me if I was sure of the member number of which also on the form there was only requirement of pension number , registered name , and postal address not other details that Maxwell is requiring to be amended of why is “scheme reference number “ that I did know of, member number that I have and the fund name which is also provided. And this only shows that the not binding rejection of funds of what is not cited correctly is scheme reference that they have and I did not have and mind you there not even a section on the divorce form that includes scheme of which if was there I would have try to require for but it wasn’t.

My fury is that I have provided the information that was needed and in their system it showed. The divorce order ruled by magistrate mentioned that I am granted to be given the spouse 50% of his fund but the old mutual says I can not access the funds without attorney or citing the scheme reference through a lawyer/attorney. Which invalidate the magistrate’s order that is granted to me. Yesterday I went to court to find out what process is. Only to find out that for the sake of citing the so called scheme reference for old mutual as Maxwell Oktober stated cost 10 000 for an attorney to process the scheme reference to magistrate of which the period of time for the process is not known excluding the six weeks mentioned by old mutual service just to proceed with the fund. Which leaves me frustrated because I am unemployed with 3kids left with loan by spouse which he is not paying. It is unfair to me and also to this miner children. Old mutual failed me. And I also know that it did fail my mother back the in 2004 when my father died. I am deeply hurt to even think that I will be going through what my mother went only the difference is that my father died and I have divorced what is the same is old mutual funding.
