Complaint against Old Mutual

I have posted many complaints about Old Mutual regarding my policy number ***3. This is a Greenlight policy and had a lump sum benefit and a temporary income incapacity benefit.

While I was on sick leave and had received payment of my temporary income benefit, the waiver of the premiums kicked in as stipulated in the terms of the policy. I have been having this problem since 2012. Old Mutual cancelled my lump sum benefit stating that two premiums were not paid, The waiver was supposed to have been in place as I was receiving my monthly benefit.

I’m December 2012, I received a lump sum payment in respect of my temporary income incapacity. Both benefits are part and parcel of the same Greenlight policy. The reasons advanced for the cancellation of my lumpsum benefit do not make sense. If the waiver kicked it for the temporary income incapacity benefit, the same app**** to the lump sum, once again because they are part and parcel of the very same policy. I did ask for the policy to be reinstated but this request was declined, once again with no valid or logical explanation. Old Mutual is aware that I have extremely poor health and are prejudicing me greatly by their refusal to reinstate my lump sum benefit. They are fully aware that I cannot qualify for disability or any other insurance due to my health. I have been in the legal profession for 26 years and should Old Mutual fail to reinstate my lump sum benefit, I will then bring an application in the High court. I know that the court will be extremely sympathetic to my medical problems and requirements and it is Old Mutual who will receive a lot of negative publicity as a matter of this nature will receive a lot of media attention.

Regarding my temporary income incapacity benefit, I received payment for approximately one year and without any notice, the payments stopped abruptly. I was reliant on this monthly benefit for my medication, medical bills and monthly necessities.

When I called to query what the problem was, the consultant told me that no such policy exists and this was immediately after the monthly payments stopped. I called a few times but to no avail. I told my physician about the monthly payments suddenly stopping without any notice or explanation and that I was told that no such policy exists when I called. He told me that Olf Mutual was prejudicing me and payments do not halt abruptly nor do policies disappear and that I should pursue this. He also told me if a person’s health is ailing, the very reason for having taken out the policy in the first place was to ensure that I would receive income/payments in the event of my health declining.

I am sure just like myself any reasonable person who takes out a Greenlight policy does so for the very reason I did which is to ensure that they will receive income should their health decline. In my case it is utterly ludicrous to be told that no such policy exists.

I have posted complaints about Old Mutual previously and I received a call where the staff member undertook to look into my problem and promised to revert to me, That has never happened.

Hopefully this time someone will call me and assist me so that I do not have to bring a High court application against Old Mutual.

I would also like others to post their negative experiences with Old Mutual please?

My complaint is once more against Old Mutual. The policy number is *** and I was the insured, Shan-na Padayachee.

Following my last complaint on HelloPeter in December 2021, I then received a response stating that this matter was resolved in 2020. I responded and stated that I received a call from a consultant following my complaint about Old Mutual ‘s repeated refusal to reinstate both my lump sum disability benefit and my temporary income incapacity benefit. All that happened was that I had to explain what is already on their system. In 2020, I received just one telephone call and the Old Mutual consultant requested additional information from me, the exact same information which has been given to numerous employees of Old Mutual since 2012.


Even though I am sick and live in pain every single day, it is extremely cruel for Old Mutual to subject me to financial hardship. The consultant whose mail I responded to, informed me that I would receive a call from someone at Old Mutual. I am back here writing yet another complaint because I did not receive the call as promised. Before I started typing this complaint, I read something else from Old Mutual, on your website, namely that they would investigate the matter and inform me what their findings are. Nine long years have passed and Old Mutual has shown no consideration or empathy for the most unfortunate position I am in because of their double standards and lack of compassion. They have shown no concern for my medical needs neither have they sat and discussed amongst themselves that a court case will result in so much negative publicity which in turn will cause many old and prospective clients to go to other insurers and many clients will no longer want to invest with Old Mutual out of fear that they may find themselves in the same predicament as I have been for so many years now.


Their Greenlight policy is very simple to understand. It is not a complicated policy document to understand and comprised of a lump sum disability policy with a value of around 1.7 million rand. at the time when it was cancelled by Old Mutual in 2012 while I was on sick leave. There is no legal justification for cancelling a policy which comprises of the temporary income incapacity benefit and the lump sum disability benefit. They were part and parcel of one policy. One premium amount was paid monthly and if the premium waiver had kicked in for the temporary income incapacity benefits, then the premium waiver for the lump sum disability benefit should have also kicked in. Instead of that happening, Old Mutual saw it fit to cancel the lump sum disability benefit and advanced the most feeble reasons for having done so. Common sense dictates that if the premium waiver for the temporary income incapacity benefit had kicked it, the same ought to have happened with the lump sum disability benefit premiums. Premium waivers exist to protect the policy owners when they are indisposed and unable to pay their premiums. If I had asked Old Mutual what amount they would have expected to receive in premiums while I was indisposed, they would have been unable to give me a figure without deducting the premiums for the temporary income incapacity benefit because both are as I said earlier part of the same policy. They were under the same policy number. All Old Mutual cared about was protecting themselves from having to pay out the lump sum disability benefit. There actions are so clear and it is also clear that their sole intent was to prejudice me. I have waited too many years and I am not prepared to wait for Old Mutual to undertake to call me and instead of calling me to discuss the problem, they have taken a unilateral decision to now investigate and revert to me. I am not at work due to my deteriorating health but I have years of experience in the legal profession and I know that Old Mutual will return and say that I let the policy lapse. When I wanted explanations as to why the premiums for the temporary income Incapacity benefit had been waived but not the premiums for the lump sum disability benefit, Old Mutual stated different rules app****. The policy document applies to both benefits as do the terms and conditions. I read that policy document many times over and no where does it stipulate that different rules apply to the premium waiver in so far as the lump sum benefit is concerned and where the temporary income incapacity benefit is concerned. I pursued this matter because I knew that their explanations made no sense and also because both benefits were the only two benefits of my Greenlight Policy and one premium was deducted. It does not require a legal mind to figure this out. Old Mutual also claimed/deducted the total amount of the monthly premiums despite the fact that they claimed only the premiums for the temporary income incapacity benefit had been waived. So their cancellation of my lump sum benefit is flawed from which ever manner you choose to view it. There again they have a problem. Why were then they claiming/deducting the total amount of the monthly premiums and not a pro ratio amount?, , after having deducted the premiums of the temporary income incapacity benefit which they claim, they could only waive the premiums for?

It had been extremely difficult and stressful to pay for my medication, blood tests, doctors accounts and the list of necessary expenses I have is a lengthy one. Many of my friends are now Senior Counsel and have visited me. They have offered to bring an application in the High Court of Pietermaritzburg so I do not have worry about the costs of legal fees. While Old Mutual can well afford the exhorbitant costs of legal fees, they have a lot to lose. Negative publicity means clients will become wary of them and take their investments and change over to other insurance companies. Old Mutual will still have clients but no where near the number they have now. Negative publicity and media coverage has been the cause of the demise of many businesses, companies and huge entities as well.

I cannot spend the last few years of my life posting complaints about Old Mutual. The time has come to take action. I shall wait to hear from someone Senior at Old Mutual by Wednesday, the 12th January 2022. Should that not happen, I will have to proceed with a High Court application.
