CLIENT SERVICES OVERULES ACTUARY

I took out a Flexidowment policy in Dec 1998 which matures in Dec 2016. I now needed to surrender the policy to pay for my sons university fees only to find out that it's under a restriction period. the query was initiated in Jan this year and from the Complaints Dept it was sent to the actuary. I was then advised that it's because I took out a \Voluntary Premium Increase"in 2010 on this flexi policy and the sales person had advised me of the \""Section 54\"" act (to which I honestly cannot recall) that I'm unable to surrender. the Actuary advised that although I took a part surrender in 2010 I can still take out a (interest bearing) loan against the policy. I was then requested to go through to Old Mutual Finance and complete the documentation. they couldn't assist as the system won't allow them to proceed due to the restriction. I was then referred to the Client Services Dept who escalated the matter to the Client Services Manager who advised OMF that it would not be possible to even take out a loan because of the restriction period. Seems like I was misinformed by the actuary or his decision was overruled. So I'm now in a predicament as I'm unable to pay for my child's studies."""
