for a friend who is battling to have estate settled, its almost year and nothing done, here is a letter from her explain: ESTATE OB ENGELBRECHT ********** 61280 - died on 26 December 2017 ACCIDENT - CONQUEST Friday night, 21 April 2018, at 2:00 am, whilst parked in front of house in 4 Berg Str, Wellington. Paul was not even at home. A 17 year old (Waldo Groenewald) under the influence of alcohol drove into the back, bumping it into the car in front of it. he was arrested at the scene and taken to the hospital for blood tests. According to the Wellington police he appeared in court on 23 April and the case was put forward untill the result of the blood tests. At this stage his father are denying the fact that he was driving – so I cannot say anything before he is found guilty or not. The case number is MAS340/04/2018 Accident Report: BR46/04/2018 I have been trying to get any more information from the police, but they say it is the estate’s responsibility seeing that I am not the owner of the car. Old Mutual Trust says that they won’t do anything because the car was only insured for theft, fire and third party and that it is my responsibility. The thing is that it does not matter because it is solely the guilty party’s responsibility to pay for the damage. According to law, I have a choice: to take the book value for the Conquest or to have it restored into the state that it was before the accident. I chose the latter. I reported the accident to Sukendrie Naidu at Old Mutual Trust on 23 April 2018. On the 2nd May I send an e-mail to her of all the details and told her that they must contact the police for further details seeing that they are Okkie’s representative in the matter. On 10 May I send another e-mail to her asking her to please handle the claim for me, even if it means that the settling of the estate will be delayed. On 15 May I send another e-mail requesting the same thing. On the same day at 14:02 I eventually got hols of Sukendrie on the phone and she promised to start this action. I also told her that we are having the Conquest repaired justt to be roadworthy as that would prevent further costs of towing away and sttoring while the claim is being delt with. So far nothing has happened and they let me know that the fact that I did not have accident insurance makes it my problem. They say I chose not to have them take out insurance. All that they asked me in January was if the house is insured and I said yes. I also send them a contract of our insurance on everything. Should they not have looked through it and advised me accordingly? THE REST On 20 April 2018, I send Sukendrie an e-mail with a copy of a letter from ABSA in which they say that the house is ready to be transfered into my name. Her reply was: “We are writing to ABSA Homeloans as the process dictates” …. Nothing up to date. I have an e-mail from Old Mutual Trust in which they give Francois Hamman (Schoeman & Hamman Attorneys in Vredenburg) permission to handle the transfer of the house into my name, but he has not received the neccesary documents from them so that he can do the transfer. Next time I heard anything from them was on 20 June, after I send e-mail on 15 June to remind them that my car license espires end of June and I need documents to renew it. On 26 June Sukendrie rep**** that it will be send. On 26 June I reminded them again – nothing. On 28 June I eventually got hold of Louise Daniels – Sukendrie was not available – and she send it through the next day. I only then found out that she is the executor of the will and that Sukendrie is only the administrative person. Sukendrie told me in the beginning that I must only work with her. On 26 July I contacted Francois Hamman about the estate and he send and he send my letter to them. They rep**** with a very unfriendly letter blaming everything on me, especially the insurance thing. From the start I always send everything that they asked for immediately. Francois also tried numerous times to take over the estate, even went to see the master of the court – with no success. Old Mutual Trust informed me that according to law they have 6 months since they have been formally appointed as executors and that was on 26 August 2018. Up till now there was no further contact from Old Mutual Trust. It has been nearly 10 months since Okkie died and nothing has been transferred into my name. I don’t even have a copy of his will. So, actually I own nothing and have no say in any matter. I feel that they have done nothing to help me through this and there is nobody at Old Mutual Trust that I can turn to for advice or anything else.
