****TY OAKHURST INSURANCE COMPANY
<p> </p> <p>My name is Nkosnathi Baloyi and this is my frustration story:<br />On the 6th of January 2017 my father purchased a Chevrolet Cruse for me at the Williams Hunt dealership in Midrand. This car was intended to be used for business mainly to be used for the Uber Business. On The same day (6th January 2017) the car was purchased and the sales man at Chevrolet referred us to Oakhurst insurance company which we joined later that day. We were given a full coverage which also included passenger liability. <br />After the purchase of the car I did all the necessary requirements that was needed before putting the car up for Uber. However I got delayed by the dealership as they were still organising the cars ownership documents. <br />On the 7th of February 2017, I decided to go visit my parents with my cousin in Malamulele in Limpopo as I stay in Centurion Midstream estate. On my way home (Limpopo) on the N1, I had hit a bursted truck tire which was left on the road. The car had a damages on the front bumper, rear bumper and the right fender. The car could still move and I drove it to the nearest police station which was in Mokopane to do an accident report. The following day I reported the accident to the ****ty Oakhurst insurance company as I am covered by them. They assigned Isaac Williams to be the person to help us with this claim. We received several calls from him asking us details about the accident.</p> <p>This ****ty insance company then gave my father a call saying that they have forwarded the claim to the investigation team since the car crashed was not on business use. I then received a call from the man investigating my claim asking me details of the accident and also called my cousin who I was travelling with the day of the accident.</p> <p>I received a call from Isaac on the 28th of February 2017, saying he can't get hold of my father. When he finally got ahold of my father, Isaac told him (my father) that the ****ty company will not be covering the accident since I crashed while on business which I find to be a stupid reason. I mean I could have gotten an accident on my way to buy bread and this ****ty company wouldn't pay it. Is this car supposed to be on the road 24/7 without taking a break since it is insured for "business" use.</p> <p>I'm reporting this because it is really unfair and now we forced to fix the car with the money we don't have as we pay about R1500 every month. Im also planning on taking this to the lawyers!</p> <p>This is also infringement of the contract with your insurance, and it will be filed with the lawyers if the matter is not handled with immediate effect</p> <p>I expect that a full on investigation is conducted and that this is resolved with immediate effect, as this is now affecting my business!</p>

We herein confirm our correspondence to you in response to your complaint with supporting documents, regarding the declination of your claim that your insured vehicle was insured as a taxi under Oakhurst Taxi Policy.
The following was established during our investigation. Mr TK Baloyi, who is the policy holder confirmed during the voice recorded proposal phone call of the policy that the insured vehicle will be used as an Uber Taxi and gave no indication that the insured vehicle was not “licensed” to operate as a taxi.
It was further advised and agreed in accordance to the policy terms and conditions that all drivers must have a valid Professional Driving Permit (PrDP) and comply with National Road Transport notices, otherwise there will be no cover at the time of an incident. It appears that the driver at the time of the accident (Mr N Baloyi) did not have a valid Professional Driving Permit (PrDP).
It is therefore the submission of this office that you did not comply with the term and condition of your policy and it is our submission that the declination of your claim was fair and will be upheld.
