Third Party Claim Abuse of process and law

Dear Hello Peter I have complaint against Oakhurst Insurance. I have a third party claim against their policyholder Philip John Hardy (reference: ST PAUL-HARDY, P-CCACLMPL00027 ) Oakhurst used all kinds of bullying and delay tactics to try and discourage me from seeing this claim through. On the 7th of August, their policyholder Philip Hardy failed to stop at a stop street and thus causing the accident. Philip Hardy and I went to the police station where he expressed it clearly that he failed to stop at a stop sign and he caused the accident. Oakhurst Sent me the settlement correspondence yesterday. 1. They acknowledge their Insured failed to stop at a stop sign and collided with my car where I had right of way 2. They claim that I am liable for 30% of their clients costs? (Like how does that even make sense) 3. They claim all this is done with regards to delictual law (hmmmm, strange, I think their entire legal team needs to go revise their delictual law)

Their client has cost my vehicle R69000 or so of damage according to the panel beaters and Oakhurst makes me a R2000 settlement offer (Yes, R2000, such disrespect). They purposely delayed giving me feedback until yesterday based on their ridiculous 60 days policy and yet they approved their insureds claim in 7 business days. It is none of Oakhursts business why my car isn't insured because I know their "smart" consultants will come and say why dont I have insurance on my car. Oakhurst claims they have stepped into Philip's shoes assuming both his rights and obligations and yet they seem to ignore all of Philip's obligations according to delictual law. There are many insurance companies who take advantage when it comes to Third party claims. Oakhurst needs to be made an example out of so this BS can stop. I have sent all correspondence to my lawyers and I will also be reporting their ********* practices to the Ombudsmen.
