Still waiting on insurance payout since January 2016
<p>I was involved in an accident 1 jan 2016, my car was written off as a result.</p> <p> </p> <p>Until today i have not received my full settlement amount. There is a third party involved (the insurer of the guy who bumped into my car), and Oakhurst refuses to pay the amount until the third party does. </p> <p> </p> <p>I feel this is unneccesary, Oakhurt should pay me what they owe, and then collect the amount from the third party and keep that for themselves.</p> <p> </p> <p>I suggested this but they refuse. </p>

We confirm that your claim on your vehicle insurance policy was settled in full as per the provision of your comprehensive vehicle insurance policy schedule and that the claim settlement amount was paid directly into your bank account less the applicable excess as dictated by the provisions contained in your policy schedule.
Leanne is busy with the recovery against the third party's insurance. Unfortunately there were some unexpected delays with getting the payment finalised by the third party’s insurance and this delay also causes a delay on the refund of your excesses as we cannot refund your excesses prior to receiving the payment from the third party's insurance. Unfortunately we do not have control in how the third party insurer runs its operations but do assure you that the recovery is being actively pursued.
Kindly take note that the excess is the first amount payable by you as the insured, this is based on your insurance contract. The insurer cannot refund the excess until it is received from the third party's insurer.

This is because the excess is your portion of the claim. The insurer's liability is towards the cost of the claim less the applicable excess that reflects on the policy schedule.
In an event that a third party caused you to suffer the loss then the insurer can institute a recovery against the third party or his insurer. Once the recovery is successful and the funds have been paid into the insurer's bank account by the third party or his insurer then your insurer can refund the excess.
