Just another "keeping my pocket happy" company

<p>I recently had an accident not involving another person or vehicle. The lid of manhole was sticking out upright and I accidently drove over it causing damage to my vehicle. Oakhurst was quick in assisting to get a tow truck out and off my car went to the panel beaters. Initially I was told that the excess would be 10% of damages, which I expected. Thereafter I was told an additional 10% x 2 would be added. So basically 1) basic excess 2) smartbox not working 3) no third party.</p> <p>Now point 1) I have already accepted. Point 2) I argued that my schedule says the monthly instalments to Altech Netstar is included in my monthly premium to Dotsure/Oakhurst, I was told that no, due to cancelling my policy I had to pay the one month arrears instalment (I did reinstate my insurance within the same month btw) and then all will be fine. I do not recall being told that and therefor did not pay the monthly instalment. So fine..lets not argue anymore on point 2). Still I get an “updated” schedule and there it still is on two separate occasions that my monthly instalment is included in my monthly premium.</p> <p>This brings me to point 3). My insurance is actually penalizing me for not hurting another person or not damaging another car….but technically speaking is the municipality not the third party?</p> <p>I was told that the legal department will assess the case and decide whether or not to take it further with the municipality, but according to an article, municipalities is liable for any damages due to their negligence. But no assistance from my insurance company, once again they did not have my back. </p> <p>I was also told that I am not entitled to the final invoice nor the assessors report as both are internal documents. So I can’t even be sure that the total excess amount is correctly calculated.</p> <p>R9000 is my excess amount and although it may not be worth it to Oakhurst, that monies for me could have bought a new washing machine, a microwave, paid a deposit on a house to rent and also a birthday gift for my daughter that is turning two.</p> <p>Currently I have been without my car for 2 months and still pay my monthly premium of R420. Paying insurance on a car that is not parked where the schedule says. It begs me to wonder if anything happens or it gets ******, will Oakhurst still cover me? I am leaning towards no, they will find an excuse or reason not to.</p>

Thank you for affording us the opportunity to review your complaint.

We confirm that when your policy incepted your monthly insurance premium was inclusive of your Altech Netstar subscription. However, this changed after the cancelation of your policy. When the policy cancelled the Altech Netstar subscription was removed from the policy and was administered/handler directly by Altech Netstar.

We confirm that policy was re-instated but your new premium did not include the Altech Netstar subscription. We listened to the policy re-instatement recording, during this phone call the consultant advised that the Netstar subscription was removed as a result of the cancelation. The went further to advise that you can get in touch with Netstar directly to have the tracking device activated and pay the subscription fee separately. During this particular call you confirmed that you will get in touch with Altech Netstar in order to re-instate your tracking device subscription. Therefore, upon re-instatement of the policy you were made aware that your premium will no longer include the Altech Netstar subscription. The additional excess that the insurer app**** for non-functional tracking unit was correctly app**** in that the duty to have the device activated and fully functional rested on you after the policy was cancelled (and re-instated).

We also went over your vehicle insurance policy schedule. The additional excess for no third party actually reads “no third party vehicle involved”. The municipality is a third party by virtue of it being a juristic person but there was unfortunately no third party vehicle involved when this accident occurred. Therefore, the additional excess for no third party vehicle will unfortunately be applicable.

We discussed the possible recovery against the municipality with one of the managers in the recoveries department. She advised that the possibilities of a recovery against the municipality are slim to none, however she will look into the merits again and advise us accordingly. In the event that the insurer elect not to proceed with the recovery we will advise accordingly and provide you with the necessary quantum documents to institute a recovery against the municipality.

We also confirm that your excess was based on the overall cost of the claim, i.e. the panel beater’s labour costs plus the amount that we paid to buy the parts needed to have your vehicle returned to its pre-accident condition.

The panel beater also advised that your vehicle is ready for collection, you just need to pay the applicable excess on the claim directly to the panel beater and the vehicle will be released to you.

The insurer performed as dictated and prescribed by your policy contract and cannot be faulted in the application of the excesses on this particular claim.
