Good Day,
I hope this mail find you well – I have a teething matter which need your attention, allow me to give you background of this matter.
• On the 18 May 2019 Oakhurst client collided with my vehicle after he failed to stop at traffic lights (Under influence of alcohol) • Accident was registered with Ekurhuleni Metro Police • Claims was submitted to Oakhurst insurance with all required documentations • In August the claim was rejected, deeming Oakhurst client was within his right of way (Which wasn’t the case) • Dispute from my side was submitted along with witness’s statements • Matter was subsequently reviewed after long battle with Oakhurst insurance & Oakhurst client as they were failing to interview the witness which they managed to do so with my push • Three months later after full six months Oakhurst insurance came back rejecting the claim though they partly acknowledge that indeed I had right of way but onus was on me to heed caution when entering the intersection, which indeed I did that however their client failed to stop at traffic light & acted recklessly/irresponsibly/careless with high speed. • I further felt very much intimidated and threatened by Oakhurst insurance tone of their email as they are protecting or condoning the DRINK & DRIVING (I could have been ****ed or paralyzed but as we speak my vehicle has been written off with damage estimated up to R145,000.00) • I take a serious offence in the manner Oakhurst insurance handled this claim and ending it with threats against me
