Dear Motlatsi Mahapa

As per the telephonic discussion that you had with our Vuyisile Ndhlovu, we confirm that your husband’s claim was declined by the insurer.

The vehicle was not serviced as per the vehicle’s manufacturer’s specification and we were also advised by the technician where the vehicle was quoted/inspected that the damage was caused due to insufficient oil in the gearbox.

This policy has a specific requirement in that the vehicle must be serviced in accordance with the manufacturer’s requirement (i.e. every 20 000km or 1 year interval, whichever comes first). Your vehicle was last serviced on the 7th of July 2014 and had also travelled for more than 20 000km since its last service. The policy also places a duty on you to make sure that the vehicle is serviced properly, that it always has correct fuels and/or lubricants and it also specifically states that we will not cover damage resulting from your own negligence, any accident, unreasonable use or any malicious damage. The failure to make sure that the gearbox had the correct amount of oil makes this particular claim to fall outside of the insurer’s scope of cover.

Based on the above the insurer’s decision cannot be faulted and the declination will be upheld.
