I was insured with Oarkhurst insurance

I was Insured by Oarkhurst insurance which I was involved in an accidents and was supposed to pay Excess of R13000 and if investigations find out I'm not guilty they will refund it back to me. And I made research find out the third party already paid everything to my Oakhurst insurance which the driver was found to be wrong my problem now my insurance told me I had to wait till the driver paid off the debts of the excess money as he agreed to pay it per month R200 so I had to wait for those years even though the third party insurance already paid.
