I onced involved in an accident

I was involved in an accident which i paid R13000 access to realese the car as per agreement, they said if it was not my mistake i get a refund of that access money. The case favour me which the insurance informed me I'll received it back since the other party settled the credit, and on the money i paid as an access R8000 was from that other driver of which the my insurance will have to pay me the balance of R5000, now the insurance is telling me I'll have to wait for that guy to pay them back then when everything is paid they will pay me but i don't see any reason as the third party insurance already settled the debt already.
