Claim not resolved

My complaint relates to two companies, i.e.:- 1. Oakhurst Insurance Company 2. Uber

On 31 May 2017 a family member used my vehicle to work and on whilst driving on his way back home and while he was stationary at a traffic light he was hit by an Uber vehicle. The Uber driver admitted that he had skipped the red traffic light and signed an affidavit stating same, i.e. the Uber driver took full responsibility of the incident.

At the scene of the incident the Uber driver refused to give the particulars of the owner or the insurance company. Eventually after numerous phone calls to Uber, Uber finally released the insurance details of their vehicle. We contacted Oakhurst Insurance and received their 3rd party claim forms. Oakhurst issued a claim number KHUMAN ********** -ACCO. All their required info was submitted to them. Since then I’ve made numerous phone calls and emails to Oakhurst and they fail to give me an update on the claim nor are they willing to release the owner’s information. Oakhurst’s representative Duran keeps insisting that Oakhurst is still within a “60 day” period to resolve claims even though it has been 108 days to date. Further, Duran, refuses to give me details of his superior or information on how to escalate my issue. My claim amount as at today is R124,355.00, all rights reserved. I have also been trying to contact Uber but they refuse to answer my emails and there is no phone number for them in SA. I am at the point where I feel I need to hand this over to a lawyer as I am getting no feedback from all the involved entities, i.e. Uber and their Taxi Company and Oakhurst.

My views:- 1. I did some research on incidents with Uber vehicles and basically Uber says that they are not liable as they are just run the software application and liability lies with the owner of the vehicle. a. Uber, if this is the case, please provide me with the details of the company that damaged my vehicle. 2. Oakhurst has acknowledge the claim however its been 108 days with no action. a. Oakhurst please give an update. b. Oakhurst please supply the details of your client 3. Oakhurst Client & Uber’s Contractor - KHUMAN ********** -ACCO a. Both Uber and Oakhurst have confirmed that you are a business client of theirs and this is confirmed by the type of insurance you have and the fact that it is a requirement from Uber. Based on this, you as a Company in SA is liable for damages caused by your employees.

As per our records, all documents requested from you in order to proceed with the claim were only received on 10 August 2017. As such, this confirms that the matter is still within the 60 day period. We further confirm that Duran from the Liability department has sent you an email regarding the progress of your claim on 09 September 2017.

Since this response from Oakhurst I have contacted them on several occasions and nothing has changed. Duran nor Theresa refuse to take my calls or reply to my emails
