HARASSMENT & TRACE ALERTS
<p>Been constantly harrased by these ********* trying to collect on a prescribed debt.</p> <p>now i receive an sms stating that a TRACE ALERT has been placed on my credit profile. Considering that they are in possession of my current contact details i find this bewildering. From what i gathered, this is ******* and i will be taking this to all legal avenues available to put these ********** out of business.</p> <p> </p> <p>let me just re-itterate:</p> <p>I would like for you to remove that trace alert because I do not owe you a cent.<br />I would also request that your agents stop calling me or sending text messages or emails.</p> <p>That account in question prescribed a long time ago.</p> <p>I would like for you to e-mail me a statement that reflects payments made in the last three years.<br />Show me proof that I made payment arrangement with you in the last three years.<br />Send me a copy of the court summons that was issued in the last three years.</p> <p>If not then please remove the negative listing you placed on my credit report.</p> <p>According to the Prescription Act 68 of 1969, section 10 (1), a debt is prescribed if:</p> <p>* You have not acknowledged the debt in the past 3 consecutive years, either in writing or verbally<br />* You have not made any payment towards the outstanding amount, nor have you promised to pay<br />* The creditor has not summonsed you for this debt within 3 consecutive years</p> <p> </p> <p>If not responded to promptly i will proceed with legal action against you for this.....REMOVE THE TRACE ALERT IMMEDIATLEY!!!!!</p>
