After hours messages

Please cease and desist all contact with me immediately.

First of all, you are harassing me after hours.

· I am getting messages at 8pm at night and 7am in the morning

Secondly you are not following the correct procedure (I know, because I work at a debt collection attorney)

1st message received on 22 August 2024 at 10:20am message reads: ”Notice of adverse listing NCA Regulation 19(4)”

2nd message received on 25 August 2024 at 7:05am (again after hours), message reads: “Final Reminder” (within 3 days????)

3rd message received on 28 August 2024 at 7:52am (again after hours), message reads: “a trace was done “

4th message received on 28 August 2024 at 12:16pm message reading: “24hrs notice of adverse listing”

5th message received on 29 August 2024 at 20:11pm (again after hours), message reading: “Section 129 Notice”

6th message received on 30 August 2024 at 7:27am (again after hours), message reading: Final Notice

As far as I know the correct procedure is the debtor gets a “letter of demand” and the debtor has 10 business days to respond. Which is not happening in this case.

I know I missed a payment of R209 (mind you this is the 1st time I have ever missed a payment), this is because my salary was paid into my account late, Telkom did try to debt my account again on the 15th of August which is strange because there were enough funds in my account and the debit order came back. So from the 15th of August I have not had a phone call from TELKOM or NUDEBT for that matter, trying to find out what is going on (mind you I do not have the airtime to be put on hold for hours at a time just to speak to someone) – I have however managed to get hold of someone from Telkom on the 16th of August 2024, a lady with the name of Ntomboxolo Mangali (***), I have asked her to please update my account details so that I can log into the Telkom portal (which is totally useless because you cannot get hold of someone, the only way TELKOM phones is if I apply for new service), she helped me with that – she also forwarded me my Telkom account so that I can make a payment from my bank account – I was told to use the Capitec registered account numbers, so in this case there are 2 Telkom Mobile and Telkom SA LTD (I used the my reference number as shown on the invoice ***) - I was not advised which one to use, so I use the Telkom Sa LTD account in which I made a payment of R209 on the 26th of August 2024. (I will forward the POP, if someone will just phone me)

I also did try to use the pay@ service, but my 19digit reference number was not picked up by the service.

So the next debit order will then go off on the 31st of August 2024 as normal. Now you send me messages that I have to pay R418 - which is payments for July (which was paid on the 26th of August) and August?

If I pay the extra R209 and Telkom debits my account for another R209 then I will be paid upfront… and you will not be refunding me, so I will wait for the debit order to go off on the 31st of August 2024.

I suggest you get your “debt collection agents” some sort of proper training so that they follow the correct procedures.

I will be laying a complaint against NUDEBT as well, as their ways of collecting are ********* and ********, and they are harassing me after/before hours and basically threatening me with SMS’s, they do not even have the decency to call me and asked what is happening, then this matter could have been resolved already.

I have logged a "please contact me" service on *** via whats app

I have also attached all my proof that I did make a payment
