SPCA shocking response

Hi my neighbour has very vicious dogs and he often leaves his gate opened. The first time I spoke to the mother of that house and she promised it won't happen again. Yesterday 08 June 2020, it was a day of taking the dust bin outside and the dogs were owning the street and I couldn't go out, then I had to go drop my son off to town in the same morning. I then opened the gate, they ran into my yard and I couldn't lock them inside, I drove to the neighbour's house and found their gate wide opened. I was extremely angry as my son was getting late because of the running around, then the owner came out and said he wasn't aware that the gate was opened. Then I asked him to get them out of my yard, instead of doing the right thing he decided to swear at me because he was sleeping. I went to the police, then they advised me to report him to the SPCA which I did. He admitted that his dogs were outside because his gate motor isn't properly functioning, and why he doesn't use it as manual until he fixes it. I was disappointed and dejected from their response, they said there's nothing they can do because it's not cruelty to animals. Now I want to know where must we report such problems?
