Dog attack in yard
<p>I am totally DISAPPIONTED at the KEMPTON PARK SPCA . On Tuesday night last week my daughter and son in law who live in Esther Parsk had a terrifying experiece that 2 PITBULLS from a neighbour behind them got over 2 6ft walls and tore their 3 Jack Russel dogs apsart , this was the 6th time the dogs were in thier yard the night before the owners came around to fetch the dogs. The SPCA were notified and informed my son in law they coukld do nothing. We then contacted the SAPS and THEY ALSO COULD DO NOTHING. We ithen as suggested by the SAPS to call the owners over and the in fromt of SAPS and 3 other witnesses said the dogs would be remove dthe following day. My daughter and son in law have 2 kids 2 and 4 what if they would pplay outside. Last week the bumped into the owners and were once again informded that the dogs were gone. They then got 2 replacement pups BUT ONLY TO BE INFORMED BY THE kEMPTON PARK SPCA TAHAT THEY WERE THERE TODAY AND THE DOGS ARE STILL ON THE PREMISES. I feel that they do not know the extent of trouble heart ache they are causing. U WILL MAKE IT MY INTENTION AS FROM TODAY TO STOP ALL SPONSERSHIP DONATIONS TO THE KEMPTON PARJ SPCA AND AM GOINGTO MAKE THIS A HUGE ISSUE I have always adopted pets cats from SPCA but never again . I will not be held liable for my actions if I visit my kids against those dogs al be it that I am a animal ***** as I have pets of my own.My next step right after this mail will be to CARTE BLANCHE to show the people of the area how SLACK the SPCA really IS</p>

As explained telephonically, the mandate of the SPCA is the prevention of cruelty to animals. Unfortunately, this issue does not fall within the mandate of the SPCA and therefore we have no jurisdiction to act. This falls within the By-laws and should be reported to the Municipality. Charges can be laid at the local SAPS for damage of property and the SAPS are obliged to open such charges. It was further explained that if the SAPS refused to open these charges that the official should then be reported to the Station Commander.
The SPCAs are only allowed to remove animals in the following circumstances:
1. The rightful owner of the animals surrenders the animals to the SPCA.
2. The SPCA obtains a warrant from the local Magistrate because the animal is being abused or neglected in terms of the Animals Protection Act no. 71 of 1962.
Neither of these two circumstances apply to this situation which will make the removal of these dogs ********.
We trust that the above clarifies and that you will direct your concerns to the Municipality, the SAPS and the owner of the aggressive dogs; and not publicly deprecate the SPCA for not ********ly fulfilling the duties of other organisations.
