Harrasment

I have received numerous calls about debt I have no Knowledge of. I have asked all 3 the ladies that called for the following<br> * A signed contract<br> * When last payment was made on the account.<br> * Was summons was ever issued for this debt.<br> <br> To date I have received no such information - Yet they started sending SMSs now.<br> <br> I Understand the following..<br> If no payment has been made on that account for 3 consecutive years and no summons has been issued for that debt within the last 3 years, then that debt is prescribed and you are not legally bound to repay that debt.<br> <br> What exactly is prescribed debt? According to the Prescription Act 68 of 1969, section 10 (1), a debt is prescribed if:<br> <br> * You have not acknowledged the debt in the past 3 consecutive years, either in writing or verbally<br> * You have not made any payment towards the outstanding amount, nor have you promised to pay<br> * The creditor has not summonsed you for this debt within 3 consecutive years<br> <br> So either close this file or offer me proof that this debt is due.<br>
