Breach of contract and defaulting on agreements with failure to rectify

Breaching of a contractual debit order agreement which is signed for the 31st of the month - in December they began “tracking” client accounts on Friday 14th and taking out money as soon as they could see that there was even just R1 over the debit order amount available in the account. Upon receiving an sms on the 14th Dec about tracking accounts, they were called and were told that they do not have permission to break the contract and take money out early. I was assured it would not be taken off a) early (in breach of contract), b) in December before a long week, c) 2 weeks before Christmas. Despite this the debit order was still taken off early. Upon seeing this I called Norman Bissett and had 11 phone calls to try get it sorted - during these calls I was hung up on a number of times. I was assured it would be reversed, which took close to a week, and we told them that, as per our agreement, the debit order could go off on the 31st. The 31st came and went and the debit order was not actioned on their side. I called them to follow up and they apologized and said they had trouble doing the manual debit order after I refused permission for them to take money early (insinuating it was my fault that they didn’t do the debit order on the 31st). Another week went by and finally this morning I received an sms notifying that the debit order went off (16th Jan). I then received a phone call from Norman Bissett asking why *I* reversed the payment in December and subsequently defaulted - only paying today. They have marked it as a fault on my behalf as opposed to a failure on their part to a) act according to the contract and b) process the debit order on the correct day. I didn’t reverse the payment in December - THEY did as per my request after they took the money early despite their assurance that it wouldn’t be since I refused their request to breach the contract. After about an hour of interrupted calls that kept cutting off I explained the whole situation and requested an email acknowledging that they were at fault. 15 minutes later I received another sms requesting authorization for the debit order to go off (after I received a bank notification 2 hours prior to say that it had already gone off). I called Norman Bissett again to find out about the sms and was told that the bank required authorization because Norman Bissett processed two debit orders for the same amount this morning which is suspicious and so they needed to know if it was correct (which it wasn’t). I now have black marks against my name with regards to my credit rating due to faults entirely on their part and will continue to fight them regarding their appalling and *********** behavior.

The original matter of the debit order has already been “resolved” - after many many attempts. The issue is the appalling behavior and incompetence that has wasted my hours and money and has resulted in what shows as my default/non-remittance where Norman Bissett was actually at fault. This tarnishing of my credit rating and failure to rectify it adequately due to a breach in a legal, binding agreement on Norman Bissett’s part in the first place is not a matter that still needs to be “resolved”, but certainly neccitates awareness to others who can avoid finding themselves in a similar situation with such an inept company who has shown little remorse in how the situation was handled. Apologizing but then falling back on the statement “it was the system’s fault” does nothing for the black marks against my name. I have emailed numerous numerous times and spoken to many people and yet I still received ANOTHER call AFTER I published the complaint and after my calls this morning to ask about my “defaulting” of the December debit order - so clearly communication is barely existent at Norman Bissett and no notes had been made on the system to clarify the matter, despite the hours I have spent on the phone to the company.
