I took a loan from eagle loans in 2004, which was taken for my studies, an agreement was signed that the money would be paid with limted interest, which amounts were paid to eagle loans until 2007. in the year 2007 i began my full time studies at the University of Mafikeng, which means i bacame unemployed and had no income, but i had informed the owner of eagle laons that i am a full time student, therefore she then said we should make arrangements for payments, but i told her i would not be able to as i was a full time student and did not have any income. the owner of eagle loans then contacted me in 2008 and she wanted to know if i had completed my studies or had dropped out on University, and i informed her that i was still studying. That was my last communication and contact with eagle loans. In 2014 i was then called by someone fro Nori Fin, who stated that she was calling from the legal section of Nori Fin, and she demanded that i pay an installment towards the loan that i took from eagle loans. I then commited to pying R500 towards th amount of money that she mentioned to me. In two to three months times while paying, i tried to open n account and realised i had a judgement against my name. I enquired about the judgement and realised it was from Nori Fin, i then called them to ask about the summons which i never received and how they got it right to get a judgement against my name while i was paying as per agreement. In 2016, i called them again and wanted to make a further arrangement of paying, the agreement was to pay R1000 a month which i payed for a couple of months, i went back to check and realised i still had a jusgement against my name, i called them again and wanted to know why the judgement was not removed of which i never received or signed the summons, and why i have to still pay these outsanding amounts while i'm still listed. I took legal action against them in order for them to remove the judgement and to return the money that i have paid towards the debt that they claim i have, this is because the matter which they are claiming or demaining me to pay has prescribed. I was never contacted for a period exceeding three years which is from 2008 to 2014. they never returned information about the dispute of the prescription instead they demanded that i foward information which proves that there is a judgement against me and until today, we cannot resolve the matter. I demand the recession of the judgement in order for me to continue with my life, because this matter has long prescribed.
