An RDP house in Mamelodi Lusaka section was advertised on the internet for sale by Hunadi properties agency and we got interested in buying it for business purposes as it was not only an RDP in the yard but also shop buildings plus two separate rooms for R280 000. Then we got in contact with an agent by the name of Daniel Tubatse, who took us to the place to view, we liked and wanted to buy it immediately. Then he took us to the conveyencers in Hatfield of which it was a white law firm to start the process but when the seller (by the name of Leeto Matsidiso) was notified about this he instructed Daniel to change the lawyers to Nkome incorporated attorneys.(one of the reputable law firm in Pretoria that even represented Marikana issue) Nkome incorporated attorneys prepared an offer to purchase, before we signed the offer we negotiated for a discount to R260 000 which was agreed upon by us and the seller. We then paid half the amount (R130 000) on the 02/2017 and then they prepared personal affidavit and an affidavit by purchaser which we signed in their offices. Thereafter we paid the remaining balance of R137 000 on 03/2017 including the conveyancing fee which Nkome attorneys sent us an invoice of. Little did we know that the RDB was not in the names of Leeto Matsidiso(the seller) and unfortunately we already sent an amount of R267 000 in cash to NKOME ATTORNEYS. Our concerns started to raise when we demanded answers from Nkome attorneys, which they couldn’t provide, we asked for the name of the trust that we sent our money to, Nelson Mathibe (Nkome Attorney)whom was assigned to do the job didn’t even know what to say, we then asked for the title deed and he couldn’t provide that . That’s when Nelson Mathibe (Nkome attorney)that we thought was conveyancing ended up telling us that they are actually not the ones conveyancing and he DOESN’T know the conveyancer (how interesting)and we should ask the Seller who told us only the name (Mabalane) but refused dismal to take us to him, mind you Nkome attorneys gave us an invoice of how much they will charge for the whole process of conveyancing (but they didn’t even know the person who does the work ) how did they come up with the fees of conveyancing if they don’t do the work? Most shocking Nelson didn’t even know the conveyancer! Being so alarmed and concerned we then called Tshwane municipality and we were shocked to find out that the RDP IS not registered in Leeto Matsidiso (seller) but Primrose Ntshoane and Timkhulu Bill, guess what? Nelson (Nkome attorney) didn’t even know this information he was shocked when we told him but in the invoice they quoted (deed search fee) because of this whole process of not being transparent and the poor service that we had received we decided to stop everything and requested for our money back. We send numerous emails, calls and letters to (Nkome attorneys) but to date we are still refused with our money for no reason. We went to Law Society to report this and up to date we haven’t received any help. It’s been a year now We just want our money back from Nkome incorporated Attorneys, as they didn’t do the job and also expose them to the society as they are not diligent in our case.
