Foreign insects found in infants milk (nestle lactogen starter infant formula one) .
I would like to express my disappointment from the unsatisfactory level of service I received from nestle. I expected much more from a prestigious and reputable company like Nestle. Unfortunately, I can’t help but make it public to the country, I had to send 3 emails of complaints to them hoping for a fast and adequate resolution which I never received. On the 6th of February, I emailed Nestle explaining my unpleasant experience of the horrifying weevils floating in the babies milk, which was found in the nestle lactogen starter infant formula one. We opened the sealed tin ( nestle lactogen starter infant formula one) to make the babies feed who is 3 weeks old. To my astonishment, while my sister was feeding the baby she noticed something black inside the bottle.She was horrified to open the bottle to find small weevils floating in the babies milk. The baby had already consumed some of the milk at the time.
Upon further inspection, we emptied the formula in a plate and found more insects. This could have been a life-threatening situation. I then received an email stating That I will be receiving a replacement, which is equivalent to the amount that was returned (Lactogen1, 250g). I Then told Koketso Bantobetse that I will not just accept a replacement, through this whole situation they expect me to accept just a replacement that to me was extremely unacceptable. She then rep**** with with the following : Nutrition and that Nestlé complies with both the spirit and letter of the Department of Health R991 Regulations relating to Foodstuffs for Infants and Young Children (0-36 months old) and I was told that the replacement policy is drafted in respect of these regulations, and they cannot replace with an amount more than what was collected. In the first place, they didn’t even comply with health regulations when they dispatched the product with weevils which were given to a 3-week old baby, but all of a sudden they want to stick to the Department of Health R991 Regulations relating to Foodstuffs for Infants and Young Children (0-36 months old).
I then received my replacement yesterday (14th February 2018 at 9.30am) which was delivered to my workplace, I did not open the package when I received it at the time as I was extremely busy at work, as soon as I got home I opened the package. I was so shocked to see that the tin was dented right in, the safety seal was opened and the milk had been spilled everywhere inside the box. I immediately took pictures. The Consumer Rights Act makes it an imp**** term of the contract that goods I receive must be of satisfactory quality and for the reasons stated above they are not.I have no words left to explain what dreadful, service I am receiving from NESTLE I hope anyone for this matter will agree with me that this is not acceptable under any circumstances, As they are in breach of contract I am entitled to more than just a replacement. I told them I am taking this to the media and they should Rest assured that once it reaches the media the reputation of Nestle Company will drop as we have many women in our country who are faithful in using your product. The manager responded to me saying she has to stick to her regulations, she does not care about me as a valued customer.
I received my second replacement today (16th February 2018 at 11.01) and the way it was packaged was identical to my first replacement, therefore, I can’t understand how the first replacement was damaged as the box was in perfect condition so it was impossible for it to have been damaged in transit. The manager confirmed over the phone that she personal packed the first replacement herself and the tin was in perfect condition, so then how was is it possible that the tin was dented so badly and the seal opened on delivery yet the box remained intact and in perfect condition this could only mean that the product was dispatched in the manner I received it there is no other explanation of this, As a woman, I can’t believe that they did not have any compassion what so ever to inquire about the welfare of the infant concerned. Obviously, they do not care about the reputation of they company which may be at stake once this incident is made public. It is rather disappointing that they treat me as they valued customer in this manner and they seem to have no remorse what so ever. Nestle was too quick to keep emphasizing on the link that you sent me regarding regulations but what about my consumer rights which clearly states that I have the RIGHT TO FAIR VALUE, GOOD QUALITY AND SAFETY a) Right to quality service, when entering into agreements or contracts, consumers are entitled to the following: • Goods that is free of any defects and of acceptable quality. • High-quality service that a consumer is entitled to. • Timely performance and completion of the services. • Notice of any unavoidable delays in the performance of the contract or service. b) Right to safe and good quality. • Consumers have a right to receive services and goods in working order, free of defects and good quality and the items must comply with any standards set under the Standards Act No 29 of 1993 and any other public regulations as published from time to time.
Please could someone help me with this situation
