NFOSA failing it's mandate.
I am writing this to warn other consumers about the National Financial Ombud Scheme South Africa (NFOSA). Despite their mission statement claiming to provide "fair, impartial, and efficient" dispute resolution, my recent experience has shown the exact opposite.Looking at all the recent complaints about them on Hellopeter looks like I am not alone
The adjudication process is riddled with procedural errors. Specifically, the NFOSA seems to have abandoned the legal standard of the balance of probabilities. In my case, they ignored probable cause and significant evidence, choosing instead to favor the insurer's narrative without critical pushback. It appears the "independence" they boast about is a facade; their rulings feel heavily biased toward protecting insurance companies rather than upholding consumer rights.
Furthermore, their communication is non-existent. When you attempt to address these procedural flaws or follow up on a case, you are met with total silence. There is no accountability for the adjudicators, and the "internal" appeal process feels like a box ticking exercise.
If you are looking for a fair hearing,rather escalate the matter to the FSCA and the Ombud Council and be sure to mention the procedural failures and not your specific case, as the NFOSA is currently failing its mandate and the South African public.
