We are extremely disappointed and frustrated with National Debt Advisors (NDA). My husband, Mr. Noufil Goolam Mohammed, never app**** for, signed, or consented to debt review. Despite this, NDA listed him under debt review in 2019.
All accounts were settled directly with credit providers in 2019, and paid-up letters were issued. Yet, in 2025, NDA suddenly resurfaced demanding R5002.50 for administrative fees from 2020 for a service that was never rendered.It is important to note that NDA did not contact my husband in any way regarding this alleged fee for the past five years. This long delay demonstrates a clear lack of proper communication and accountability, and makes their sudden demand in 2025 unreasonable, unfair, and legally questionable. They are refusing to remove the debt review status, preventing us from securing essential financial services like a home loan.
This situation has been extremely stressful and emotionally taxing, especially as we are caring for a newborn baby while trying to secure our financial stability.
Legally, NDA’s actions are ********:
Section 86(1) of the National Credit Act (NCA 34 of 2005) requires that a consumer must voluntarily submit a signed Form 16 to enter debt review. Verbal consent is not sufficient. My husband never agreed nor did he sign this form.
Section 71 of the NCA requires that once all debts are settled, the debt review status must be removed, and a clearance certificate issued. NDA has failed to comply.
Their demand for retroactive fees for a service that was never agreed upon or rendered violates the Consumer Protection Act (CPA) and the NCR Code of Conduct.
We have involved attorneys and are in the process of escalating this to the National Credit Regulator (NCR). NDA’s refusal to remove the debt review listing is not only ******* but also causing unnecessary emotional and financial hardship.
Consumers deserve to be treated fairly, transparently, and lawfully, without being trapped under debt review years after fulfilling their obligations.
We kindly urge you to resolve this matter with great urgency. If this is not resolved immediately, we will instruct attorneys, escalate to the NCR, and seek damages for the ******** listing and the emotional and financial harm caused. NDA must remove my husband’s name and confirm no fees are owed without further delay.
