Lodged a query/complaint and have not heard anything ever since. Does certain statuses apply. Just because i'm an ordinary individual, my plea is not worthy.

The question that i've posed to the presidential office where i was referred to the NCC and they referred me to the NCR, was:

What and where is the justice in individuals that consider debt review, as a mean to start over on a clean slate or individuals that are simply ignore their debt, wait for 5 years and their credentials are removed from the record. They carry on with all possibilities and options, but some of us who tried to do the decent thing are stuck at one place.

The following was forwarded to the NCR and they have not even bothered to view my concern or perhaps refer to someone

From: Samantha Daniels
Sent: Wednesday, July 27, 2016 1:46 PM
To: ********** /> Cc: ********** /> Subject: Debt Review
Importance: High

Good day.

I’ve initially referred the below matter to the NCC, but was advised that this is a matter for the NCR.

Please view the below email with my query as well as the complaint I have against JC VAN DER MERWE AND ATTORNEYS.

I’ve seek debt counseling early 2011 and so the above mentioned company accepted my request pertaining to pay off my debt. I was placed under debt review and it was communicated to me that after 5 years (2016) I’ll be done with all the debt owed to the different companies.

I called in the beginning of February , just to confirm the above and the consultant confirmed that I’d be finished with the account by end of February. Excited by the news, because for the first time. I could start to live my life again, I started to do enquiries and was told that the information pertaining to the 5 years was incorrect and that my status will be cleared, but it will take another year.

From: Samantha Daniels
Sent: Monday, February 29, 2016 11:00 AM
To: 'Milanie van der Merwe'
Subject: RE: STATEMENT: S.R. Please bear in mind that I’m a single mother of two and I do not just have any amount of money at my disposal. It was agreed that I would make a standard payment of R750.00 which was what I’ve been paying since 2011, but this of course meant that the duration of the payment interval would be longer.

A request was forwarded to the paymaster indicating that the R750.00 will no longer be deducted directly from my salary but that I (client) would make direct payments. I was requested to get a stop order from my bank, and forward confirmation thereof.

I’ve requested that the stop order in the amount if R750.00 go off on the 26 of every month as this is the day we get paid. The 26 June 2016 fell on a Sunday and therefore my company released the money into the accounts on the 25 June 2016. All my debit orders went off and on Sunday afternoon, with the knowledge that the stop order also went off, proceed to do pay my rent, do my grocery shopping ,paying accounts etc.

I was brought to my attention, two days after the 26 June 2016 by JC VAN DER MERWE AND ATTORNEYS that they have not received any payment and would proceed to close my file. I called Capitec who informed me that Sundays are not deemed a business day and therefor the amount towards the stop order did not go through. I forwarded a message to the consultant that assisted me upon my visit to their offices, and was advised that the file would be closed and all the money that I’ve paid for the past 5 years (close to 50 000) would be down the drain. I’ve pleaded with the consultant and he informed me that he was not in charge of the decision making. I’ve pleaded that they give me one week’s grace period, which was done, but sadly I did not meet my commitment to pay the R750.00. 4 days thereafter I was informed that the file is closed indefinitely.

An amount of R750.00 towards the stop order for JC VAN DER MERWE AND ATTORNEYS went off on the 26 July 2016. I’ve asked the consultant if the file was closed indefinitely. If so I would request that the money be transferred back into my account, because it’s pointless making payment when they refuse to assist me any further, and this was the feedback that was forwarded to me:

From: JCVDMA Debt **********
Sent: Wednesday, July 27, 2016 12:21 PM
To: Samantha Daniels
Subject: SAMANTHIA RUSHIDAH DANIELS. Clearly I was only a number, so all the payments I’ve made in attempt to pay off all the creditors, close to R50 000 was in vain.

So my question again, where is the justice in individuals acknowledging that they were irresponsible and taking the responsibility by paying their debt in an attempt to live. Or do we as 90% of people living in this country say…….i’ll never seek debt counselling in order to pay my debt, I’ll wait for 5 years and after 5 years all these debt are removed from my credentials and my credit record clear, then I can live a normal life.

After I was issued with the 74Q Certificate, I had a lot of questions. JC VAN DER MERWE AND ATTORNEYS have not answered any of them.

From: Samantha Daniels
Sent: Friday, May 27, 2016 1:27 PM
To: 'JCVDMA Debt'
Subject: RE: SAMANTHIA RUSHIDAH DANIELS. With the knowledge that I was finally done with all the debt, I started to apply for home loans or housing developments, but this was declined as I was advised that credit status was to poor.

Puzzled and disappointed, I approached the attorneys that handled the consolidation of my debt and was informed that the feedback pertaining to 5 years was incorrect. This is due to the fluctuation of the interest rates. I apparently have to wait another year.

Pleading with the lawyers as the need to have my own house was a need and a desire, I was advised that I could apply for a 74Q Certificate, where the status (under debt review) will be removed from my credit record and will no longer reflect, but it will cost me additional. The attorneys requested upfront payment and I managed to pursued them to reach an agreement where the overall payment of R750.00 will continue for a longer period until this particular bill was settled.

I received confirmation of the 74Q Certificate but the status (under debt review) still reflects on my credit record and the attorneys referred me Transunion in order to update my credit record. This alone is another mission, because no one shows any interest in assistance. This means that I still cannot apply for a house.

The question and concern I’ve raised was the below.

From: Samantha Daniels
Sent: Tuesday, July 05, 2016 11:54 AM
To: ********** /> Subject: Know The Law
Importance: High

Good day.

The following might not have any merit, but I think it’s necessary or relevant to ask.

I somehow feel that opting for Debt review was a waste of time.

People reckon that if under Debt review you *****ed, cause you can practically do nothing, coz wherever you go i.e. apply for a home loan, car etc. all people view is that you are a bad payer.

The reason why I’ve opted for debt review was me trying to acknowledge my misdemeanors and doing the responsible thing.

This has back fired, because I don’t trust the company that has been helping me. 5 Years have passed and this thing is still dragging on and ruining my life.

People say, just don’t care about your debt, because after 5 years, all that debt will be removed from your name and you carry on living.

Mr. President I can no longer stay in other people’s back yards and make them rich or pay of their bonds, whereas I can pay off my own bond.

As a South African citizen, am I not allowed a house for myself and my children?

I am not asking for free housing, I’m willing to pay. I pay rent to a homeowner every month, which is confirmation that I can make affordable payments towards my own house if given a chance or afforded an opportunity to build a life for myself and my children.

So how does it work? Where is the justice in individuals paying of their debt and individuals ignoring their debt, where they wait for a duration of 5 years and be debt free.

It would be of great appreciation if you can assist me in this matter and as such I remain at your disposal.

Kind Regards
