OPENN LETTER TO KEVIN PAUL MD OF NAMBITI TECHNOLOGIES
<p>Dear Kevin Paul (MD of Nambiti Technologies)</p> <p>In October 2015 your company Namibiti Technologies approached me for my services in one of your projects in Polokwane at Capricorn District Municipality (CDM) to help you deliver the reports to finish your project. The contract I signed with you was for a month (160 hours) to deliver the reports on a hourly rate agreed, the information which was given to me through your recruitment manager was that all the underlining processes of the system were built and done what was outstanding were the reports. On my arrival at the site when doing my investigation on the system I find out that the system was not ready for the reports to be built, there were still lots of background work that still needed to be done before I can be able to produce the reports. I sent my findings to you through your Sales Manager with my new timelines, that it will take me approximately 3 months to produce these reports based on the additional work still to be done. I will need a new contract to cover these findings from Nambiti Technologies and the payment must be on a monthly basis. I also gave you a suggestion on how we can breakdown the contract. Your sales manager gave me feedback from you that I must continue with the project with the new timelines a new contract will follow.</p> <p>I sent many emails to your HR manager asking for a new contract, she said I must not worry she is communicating with you and I must continue with the work that needs to be done (I have all those emails with me). I had been sending to your financial department my timesheets on a weekly basis on work done and signed by the client as requested by you. On end November I was excepting my first payment which I didn’t get, I kept on sending emails to your company via your HR and Sales Manager asking about my contract and payment while I was still continuing with the work. The reply I got was that they are still waiting for your approval (started to raise my eyebrows as I was told that you said I must continue). After many emails that were sent to me from different members of your staff, not even knowing now who am I suppose to deal with everyone was involved. On the 10th December 2015 you deposited money in my account through EFT wish was far less that what I was expected, in fact payment of less than two weeks claims. I felt that was an insult to me and my profession, I stopped working immediately because I couldn’t continue working on the project if I was not paid what was due to me for my services. I have sent lots of emails to you personally after I managed to get your details which I was asking for from your staff and being told that they are not allowed to give out your contact details, that as well was so strange to me because I was not a stranger I was contracting to you. You never bothered to reply to my emails up to date asking you to tell me want is going on. Another member of your team called me to arrange a meeting to sort these issues up to date that meeting never happened because I was informed that you are not available, strange enough when I called your offices I was told you were around conducting interviews and going on with your business (I guess I was not important or not a priority to you).</p> <p>In January 2016 again I started where I left off asking for a meeting to resolve these issues to no avail. I decided to approach my lawyer to write a letter of demand. You responded through your lawyer NOT even addressing the content of the letter (that was another insult) your consent was more on the paragraph that was stating the actions I am going to take to expose you. 3 days after the reply from your lawyer you sent your Sales Manager again to contact me to ask if I am still willing to sit with you to resolve these issues or I want to go the legal route. I said “YES I will avail myself for that meeting, he must send me an email requesting the meeting and attach the agenda” which he did. I waited again for over two weeks without any movement for that meeting. I again sent emails to you with no reply on your side (what you do best). We met with lawyers to try and solve the dispute but we didn’t agree on term. I was never paid to this date. Why consultants MUST use lawyer in order for you to pay them? I won’t talk about your clients I will leave that to them.</p> <p>I am writing this open letter to you to make other Consultants out there aware who are/will be approached by your company to be aware of your treatment. After doing my investigations I found that I am not the first consultant to be treated this way by your company. I want to put a STOP to it. Even your clients are aware of your behaviour/misconduct towards consultants. When I was at CDM most of the employees there that I was doing work for said to me “I hope Nambiti will pay you because they don’t want to pay consultants you are the 4th consultant here all the previous ones left because of payment issues” I should have listened to what they were trying to tell me.</p> <p> </p> <p>Yours sincerely</p> <p>Lonwabo Tunyiswa</p>
